The respondent Police has opened the History Sheet in H.S.No.10 of 2019 as against the petitioner. The petitioner has moved this application to revoke the history sheet pending against the petitioner. 2.The learned Additional Public Prosecutor submits that the petitioner is involved in a murder case pertaining to an FIR in crime No. 241 of 2018. He fairly submits that the said FIR has ended in acquittal in S.C.No.189 of 2019, dated 28.04.2022. Apart from this murder case, proceedings under Section 110 Cr.P.C was initiated as against the petitioner. The learned Additional Public Prosecutor further submits that the case of the petitioner would be reviewed by the respondent police in the forthcoming meeting.
3.This Court considered the rival submissions made. 4.Based on a solitary case, which was registered in crime No.241 of 2018 it appears that the respondent police has unnecessarily opened the history sheet in H.S.No.10 of 2019, which was also tried in S.C.No. 2/4
189 of 2019 and the petitioner was acquitted on 28.04.2022. Even thereafter, the respondent police have not reviewed the case of the petitioner in the history sheet and therefore, this Court is inclined to quash the history sheet in H.S.No.10 of 2019, on the file of the respondent police. Accordingly, the history sheet in H.S.No.10 of 2019, on the file of the respondent police is hereby quashed. In fine, the writ petition stands disposed of.
