ORDER

The present Contempt Petition has been filed alleging violation of the orders of this Court dated 30.01.2023 made in W.P(MD) No.1700 of 2023, wherein this Court has directed the implementation of the benefits under the wage settlement.

2. The learned counsel appearing for the respondent has filed an affidavit, dated 09.09.2024, the relevant portion in paragraph No.4 is extracted as follows:

"4 ...... However, owing to the financial constrain, this respondent could not settle the amount. As per our calculation, the writ petitioner is entitled for Rs.57,471/- towards gratuity, Rs. 26,946/- towards difference in leave salary and I undertake to pay the same in installments. As such, the difference of Gratuity amount was paid thro' ECS on 01.06.2024 & 22.07.2024 respectively. The difference of Leave salary amount of Rs.26,946/- would be paid in 5 equal monthly installments commencing from October - 2024 to February - 2025 owing to the financial constraints of the corporation. As such, I have no willful intention to 2/4

disobey the orders of this Court and I pray to this Hon'ble Court may be pleased accept this affidavit and purge me out of contempt in Cont.Pet.(MD) No. 1335 of 2024 and this render justice".
