Prayer: Petition - filed under Section 24 of the Civil Procedure Code, to withdraw H.M.O.P.No.130 of 2018 on the file of the Family Court, Dindigul and transfer to the Family Court, Trichy for disposal of the same on merits and in accordance with law. ORDER

The petitioner got married to the respondent on 19.05.2016. The marital relationship appears to have come under strain. Therefore, the respondent herein filed H.M.O.P.No.130 of 2018 before the Family Court, Dindigul. The petitioner is based in Trichy. Therefore, it will be difficult for the petitioner to go over to Dindigul and contest the proceedings there.

2. Taking into circumstances obtaining in this case, H.M.O.P.No.130 of 2018 is withdrawn from the the Family Court, Dindigul, and transferred to the file of the Family Court, Trichy. The respondent however, need not appear in person before the Family Court, Trichy, on all occasions. Of course, he has to appear on counselling date and on dates, when his examination as witness is necessary. On all other occasions, he can be represented through his counsel.

3. Accordingly, this Transfer Civil Miscellaneous Petition is allowed. No costs. Consequently, connected Miscellaneous Petition is closed.
