Prayer: Petition - filed under Section 24 of the Civil Procedure Code, to withdraw the H.M.O.P.No.348 of 2017 on the file of the Family Court, Trichy, and to transfer the same to the file of the Hon'ble Family Court, Sivagangai.

ORDER

The petitioner got married to the respondent on 24.10.2007. Two children have been born through the said wedlock. The children are with the petitioner. The marital relationship between the parties appears to have come under strain. The respondent filed H.M.O.P.No.348 of 2017 before the Family Court, Trichy. The petitioner is based in Sivagangai. It will be difficult for the petitioner to go to Trichy and contest the proceedings there.

2. Taking into circumstances obtaining in this case, H.M.O.P.No.348 of 2017 is withdrawn from the the Family Court, Trichy, and transferred to the file of the Family Court, Sivagangai. The respondent however, need not appear in person before the Family Court, Sivagangai, on all occasions. Of course, he has to appear on counselling date and on dates, when his examination as witness is necessary. On all other occasions, he can be represented through his counsel.

3. Accordingly, this Transfer Civil Miscellaneous Petition is disposed of. No costs. Consequently, connected Miscellaneous Petitions are closed.
