CORAM
THE HON`BLE MR.JUSTICE B.PUGALENDHI P.Selvi ... Petitioner versus
1. The Superintendent of Police,
2. The Inspector of Police, Ilaiyankudi Police Station,
3. Rohini ... Respondents Prayer : Petition filed under Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023, to call for the entire records pertaining to the impugned closure report order passed by the 2nd respondent in CSR No.400 of 2025 dated 30.04.2025, set aside the same and consequently, direct the 2nd respondent to investigate the petitioner's complaint dated 01.04.2025. For Petitioner : Mr.S.Balaji For R1 and R2 : Mr.A.S.Abul Kalaam Azad, Government Advocate (Crl. side) 1/4
ORDER
The petitioner, with a grievance that the respondent Police, without conducting any proper investigation on her complaint dated 01.04.2025, closed the same in a mechanical manner, has filed this petition to set aside the closure report in CSR No.400 of 2025 dated 30.04.2025 and seeking further investigation.
2. The learned counsel appearing for the petitioner submits that the petitioner has not been even summoned for enquiry. Without conducting any proper investigation, the respondent Police has closed the petitioner's complaint.
3. Mr.A.S.Abul Kalaam Azad, learned Government Advocate (Crl. Side), who takes notice for the respondent Police, denied the same and produced a copy of the summon dated 26.04.2025 issued by the respondent Police calling upon the petitioner for enquiry on 29.04.2025 at about 10.00 a.m. Since it is purely civil in nature, they have closed the 2/4
petitioner's complaint.
4. The petitioner is claiming that without even summoning her for enquiry, the complaint was closed. However, the respondent claims otherwise. Be that as it may, since the closure report has now been filed, if the petitioner is having any grievance against the closure report, it is always open to her to establish her case by filing a private complaint before the concerned Judicial Magistrate. This Court cannot conduct a roving investigation in this regard by entertaining this petition.
5. Accordingly, this Criminal Original Petition is dismissed. 10.06.2025 Index : Yes / No.
