ORDER
The present Writ Petition has been filed for the issuance of a Writ of Certiorarified Mandamus, to quash the impugned check slip passed by the 3rd Respondent in RFL/Radhapuram/25/2025, dated 05.05.2025 and consequently, to direct the 3rd respondent to register the settlement comprised in R.S.No. 162/4A1A1A1 to an extent of 7.75 cents (building and house site) situated at Chettikulam Village, Radhapuram Taluk,Tirunelveli District presented vide No.TP/218576584/2025.
2.Through the impugned order, the respondents have stated that the land in question is registered as housing site and the petitioner has not submitted any approval layout.
3.On perusal of the encumbrance certificate, it is seen that even in the year 2013, the same survey number was sold as housing site. Therefore, the exemption clause granted under Section 22(A) would save the said registration. Therefore, the impugned refusal slip is incorrect and it shows non application of mind. Therefore, the impugned refusal slip is set aside and the respondents are 2/4
directed to register the document within a period of four weeks from the date of receipt of a copy of this order.
4.With the above observations, this Writ Petition is allowed. There shall be no order as to costs.
