Prayer: Writ Petition filed under Article 226 of the constitution of India, to issue a writ of Certiorarified Mandamus, to call for the records relating to the impugned order passed by the third respondent in No.V-15014/CISF/4thRB(S)Maj.36/SR/DISC/2017/5127 dated 14.11.2017 and quash the same and consequently direct the third respondent to appoint the petitioner with all attendant benefits.

2.The learned counsel for the petitioner seeks to withdraw the Writ Petition with liberty to file an appeal under Rule 46 of the Central Industrial Security Force, 2001 before the second respondent and he has also made an endorsement to that effect. 3.If such appeal is filed within the prescribed period of limitation, the same shall be duly examined and final orders passed on merits in accordance with law within a period of four months from the date of receipt of such appeal. 4.Accordingly, this Writ Petition is dismissed as withdrawn with such liberty to the petitioner. No costs. Consequently, connected miscellaneous petition is closed.
