Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus, directing the 2nd respondent to pass suitable orders to remove the encroachment in nearby path way of the petitioner's land in R.S.Nos.62/3A and 62/3B at Maraneri Village, Sivakasi Taluk of VirudhuNagar District based on her appeal dated 30.05.2016 of Public Path Way according to law within stipulated time limit.

O R D E R

[Order of the Court was made by G.R.SWAMINATHAN, J.] The writ petitioner seeks removal of the encroachments committed in the pathway in R.S.Nos.62/3A and 62/3B at Maraneri Village, Sivakasi Taluk of Virudhu Nagar District. He has given a representation dated 30.05.2016 in this regard. https://hcservices.ecourts.gov.in/hcservices/ 2.The Tahsildahr, Sivagangai issued memorandum in Na.ka.No.A2/781/2013 dated 28.01.2013 calling upon the Revenue

Inspector, Sivagangai to submit a report in this regard. But there has been no follow up action.

3.This Court therefore directs the third respondent to take follow up action and cause removal of the encroachment in question, after issuing notice to the concerned parties and after following the statutory procedure. The entire exercise shall be completed within a period of three months from the date of receipt of a copy of this order.

4.This Writ Petition is disposed of with the above direction. No costs.
