ORDER

The Management has preferred this writ petition as against the award passed by the Labour Court, Madurai, in I.D.No.20 of 2017 dated 02.06.2020.

2. The Industrial Dispute has been raised by the Union, challenging the order of punishment passed by the petitioner Transport Corporation as against a Conductor, imposing the punishment of stoppage of increment for a period of one year with cumulative effect. The Labour Court, by order dated 02.06.2020, allowed the industrial dispute on the ground that the order of punishment has been passed by the Transport Corporation without conducting an enquiry.

3. It appears that the punishment has been imposed without conducting an enquiry.

Therefore, this writ petition is dismissed, however, with liberty to the petitioner Management to conduct a proper enquiry by affording opportunity to the workman and thereafter, take a decision on merits and in accordance with law, as expeditiously as possible.
