Petition filed under Article 226 of the Constitution of India, praying for the issuance of a Writ of Mandamus directing the respondents to consider the petitioner's representations, dated 06.05.2016 and 20.05.2016 in view of the proceedings of the Engineer-in-Chief, Public Works Department, Chepauk, Chennai-5, who is the head of Department for Public Work Department both irrigation and buildings and authority for whole establishment welfare of this Department in Na.Ka.No.S4(1)/30410/2003-1, dated 07.02.2008 and in Lr.No.S4(1)/61933/2011, dated 13.12.2011. ORDER
The petitioner Mrs.S.Saradha, who was appointed as 'Daily Wage Employee' on contract basis in "Chittar Basin Sub-Division, Tenkasi" on 01.11.1997, has been working continuously under the respondent Department for the past 19 years without regularization https://hcservices.ecourts.gov.in/hcservices/
of service and hence, she has made a representation on 06.05.2016, requesting the first respondent to consider her case since the State Government has evolved a Scheme for regularisation of daily wages employees, in the light of the communication in Na.Ka.No.S4 (1)/30410/2003-1, dated 07.02.2008 issued by the Engineer in Chief, Public Works Department, Chepauk, Chennai and yet another communication in Lr.No.S4(1)/61933/2011, dated 13.12.2011. Since the said representation is said to be still pending, the petitioner has come forward with this Writ Petition for the above stated relief.
2. Mr.M.Murugan, learned Government Advocate, who took notice on behalf of the respondents sought for reasonable time to consider the petitioner's representation.
3. In view of the above, considering the limited scope of the prayer made, this Court directs the respondents to consider the representation of the petitioner, dated 06.05.2016, on the basis of the communication in Na.Ka.No.S4(1)/30410/2003-1, dated 07.02.2008 issued by the Engineer in Chief, Public Works Department, Chepauk, Chennai and Lr.No.S4(1)/61933/2011, dated 13.12.2011, within a period of ten weeks from the date of receipt of a copy of this order.
With the above direction, the Writ petition is disposed of. No Costs.
