ORDER

The petitioner herein seeks a direction to the respondent to consider her representation dated 13.11.2024 and issue patta in her 1/5

favour in respect of the property comprised in S.F.No.52/A1, measuring an extent of 0.50 cents, situated at Panayakurichi Village, Thiruverambur Taluk, Tiruchirappalli District, within the time fixed by this Court. 2.Heard the arguments of the learned counsel for the petitioner, Mr.M.Gangatharan, learned Government Advocate, who takes notice for the respondent. By consent of both parties, this Writ Petition is taken up for final disposal at the admission stage itself. 3.It is the case of the petitioner that she purchased the above mentioned property from one Maruthaiyapillai under a registered sale deed, dated 28.10.2024. It is further stated that the computer patta for the subject property was wrongly issued in the names of one Murugan and Dhanapaul without any documents and hence, the petitioner submitted a representation on 13.11.

2024, seeking cancellation of the patta issued in the names of said Murugan and Dhanapaul and issuance of patta in the name of the petitioner. The said representation has not been considered. Hence, the petitioner has come before this Court. 4.

petitioner will be considered on its own merits within the time stipulated by this Court.

5.It is seen from the typed set of papers that the above said Murugan and Dhanapaul already instituted a suit in O.S.No.560 of 2024 on the file of II Additional District Court, Trichy, seeking declaration of title and for injunction. They also sought for declaration that the sale deed executed by Maruthaiyapillai in favour of the petitioner was null and void and unenforceable in law.

6.In view of the pendency of the civil suit, concerning the substantial rights of the parties, this Court is not inclined to issue any positive direction to the respondent to issue a patta in the name of the petitioner. However, without expressing any opinion on the rights of the parties, this Court is inclined to direct the respondent to consider the representation of the petitioner dated 13.11.2024 and pass final orders on its own merits within a period of 12 weeks from the date of receipt of a copy of this order, after issuing notice to the petitioner and the above said Murugan and Dhanapaul.

7.With the aforesaid directions, this Writ Petition stands disposed of. No costs.
