Respondents PRAYER: Writ Petition is filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus directing the respondents 1 to 3 to remove the encroachment made in the path way situated in Survey 877/16 having total extent of 0.00.35 sq.meter with 2 meter width at Velimuthi Village, Maveeduthikottai Post, Devakottai Taluk, Sivagangai District by considering the petitioner's representation dated 09.01.2017 within stipulated time to be fixed by this Court. For Petitioner : Mr.S.Muthukumar For Respondents 1 to 3 : Mr.T.S.Mohammed Mohideen, Additional Government Pleader.

ORDER

[Order of the Court was made by K.K.SASIDHARAN, J.] The petitioner filed this writ petition to direct the respondents 1 to 3, to remove the encroachment made by the fourth respondent in respect of the pathway in Survey No.877/16, Velimuthi Village, Maveeduthikottai Post, Devakottai Taluk, Sivagangai District.

2.We direct the third respondent to consider and dispose of the representation submitted by the petitioner dated 09.01.2017 on merits and as per law, after issuing notice to the fourth respondent. Such exercise shall be completed within a period of four months from the date of receipt of a copy of this order. 3.The writ petition is disposed of with the above direction. No costs.
