(MD)No.13987 of 2023] PRAYER: Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the respondents 2 and 3 herein to consider the petitioner's representation dated 03.04.2023 for a fair and proper enquiry pursuant to the enquiry summons Ref.No.Na.Ka.2849/A4/2023 dated 06.01.2023 with due opportunities to the parties concerned and consequently direct the first respondent herein to call for the records of information on the enquiry conducted by respondents 2 & 3.

This Writ Petition has been filed seeking for a Mandamus to direct the respondents 2 and 3 to consider the petitioner's 2/6
representation dated 03.04.2023, seeking for a fair and proper enquiry pursuant to the enquiry summons dated 06.01.2023. 2.It is now brought to the notice of this Court by the learned Special Government Pleader appearing for the official respondents that subsequent to the filing of this Writ Petition, a proper enquiry was conducted with regard to sexual harassment allegations made by the petitioner, which is the subject matter of this Writ Petition and an enquiry report has been submitted by the enquiry officer on 30.01.2023, which reveals that a false complaint has been lodged. The learned Special Government Pleader appearing for the respondents would submit that if at all the petitioner is aggrieved by the findings rendered in the enquiry report and the final order passed by the respondents, the petitioner will have to challenge the same separately in the manner known to the petitioner under law.
3.The grievance of the petitioner in this Writ Petition is that a proper enquiry will have to be held with regard to her sexual harassment complaint. Since an enquiry has been held subsequent to the filing of this Writ Petition and an enquiry report has been filed holding that the accused is not involved in any sexual harassment, 3/6
the petitioner will have to necessarily challenge the enquiry report and the final order in the manner known to the petitioner under law. 4.After recording the fact that an enquiry has been conducted and an enquiry report has been filed and a final order has been passed, subsequent to the filing of this Writ Petition, this Writ Petition is disposed of, by granting liberty to the petitioner to challenge the findings rendered in the enquiry report as well as the final order passed, if so advised in the manner known to the petitioner under law.
