PRAYER: This Criminal Original Petition filed under Section 482 Cr.P.C. to direct the learned Judicial Magistrate No.IV, Tirunelveli to expedite and complete the trial in S.T.C.No.128 of 2016 pending on the file of the learned Judicial Magistrate No.IV, Tirunelveli within stipulated time that may be fixed by this Court. ORDER

This Criminal Original Petition has been filed to direct the learned Judicial Magistrate No.IV, Tirunelveli to expedite and complete the trial in S.T.C.No.128 of 2016 pending on the file of the learned Judicial Magistrate No.IV, Tirunelveli within stipulated time that may be fixed by this Court.

2. Heard learned counsel appearing for the petitioner and learned Government Advocate (Crl.Side) for the respondents and perused the materials placed on record.

3. The learned counsel appearing for the petitioner would submit that, the evidence on the side of the complainant was closed by 28.09.2017 itself and the case has been adjourned from time to time without any progress. The complaint pertains to offence under Section 138 of Negotiable Instruments Act.

4. In the facts and circumstances of the case, there shall be a direction to the learned Judicial Magistrate, No.IV, Tirunelveli to conclude the proceedings in S.T.C.No.128 of 2016 within a period three months from the date of receipt of a copy of this order. https://hcservices.ecourts.gov.in/hcservices/
