Prayer: Writ Petition filed under Article 226 of the constitution of India, to issue a writ of Mandamus, directing the 1st respondent to consider and to pass an order on the appeal preferred by the petitioner on 28.03.2016 within the time that may be stipulated by this Hon'ble Court.

By consent, the writ petition itself is taken up for final disposal.

2. Mr.T.S.Mohamed Mohideen, learned Additional Government Pleader, takes notice for the respondents.

3. Alleging that the third respondent, without appreciating the material facts, has rejected the petitioner's claim to set up a stockyard in his land, the petitioner has preferred an appeal before the second respondent and after the intervention of this https://hcservices.ecourts.gov.in/hcservices/

Court, the said appeal came to be disposed of by the second respondent, by an order dated 10.03.2016. Being dissatisfied with the dismissal order of the second respondent dated 10.03.2016, the petitioner has preferred a second appeal before the first respondent as early as on 28.03.2016. As the same is kept pending, without any action, the petitioner is before this Court, again, seeking a direction for early disposal of his second appeal.

4. The learned Additional Government Pleader appearing for the respondents, on instructions, submitted that the authorities are inclined to pass orders on the second appeal of the petitioner, on merits, within a stipulated time limit.

5. Considering the facts and circumstances of the case, this Court, without going into the merits of the petitioner's claim, directs the first respondent to dispose of the appeal of the petitioner dated 28.03.2016, on merits and in accordance with law, after affording due opportunity of hearing to the petitioner as well as all the other interested parties, if any, within a period of eight weeks from the date of receipt of a copy of this order.

6. With the above direction, this Writ Petition is disposed of. No costs.
