PRAYER: Writ petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus directing the 1st respondent to take appropriate action in the petitioner's representation dated 16.10.2017, consequently, the 3rd respondent survey the petitioner's land in S.No.200/5 an extent of 53 cents, S.No.200/6 an extent of 12 cents, S.No.201/2 to an extent of 76 cents, S.No.201/3, to an extent of 3 acres 37 cents, S.No.202/9, extent of 76 cents and S.No.304/1 extent of 1 acre 76 cents, are situated in Palaniyur, Dharumathupatti, Palaya Kannivadi Village, Dindigul West Taluk, Dindigul District with the help of the 2nd respondent. For Petitioner :Mr. K.Asok Kumar Ram For R1 to R6 :Mr.M.Alagadevan Special Government Pleader.

O R D E R

This Writ petition has been filed by the petitioner for issuance of a Writ of Mandamus directing the first respondent to take appropriate action in the petitioner's representation dated 16.10.2017, consequently, the third respondent survey the petitioner's land in S.No.200/5 an extent of 53 cents, S.No.200/6 an extent of 12 cents, S.No.201/2 to an extent of 76 cents, S.No.201/3, to an extent of 3 acres 37 cents, S.No.202/9, extent of 76 cents and S.No.304/1 extent of 1 acre 76 cents, are situated in Palaniyur, Dharumathupatti, Palaya Kannivadi Village, Dindigul West Taluk, Dindigul Distrit with the help of the second respondent.

2.The learned counsel for the petitioner would submit that the petitioner would be satisfied, if his representation dated 16.10.2017 is directed to be considered within a time frame stipulated by this Court.

3.Considering the limited scope of the prayer now sought before this Court by the learned counsel for the petitioner, without expressing any opinion on the merits of the petitioner's case, this Court is inclined to pass the following direction: "The fifth respondent is directed to consider the petitioner's representation dated 16.10.2017 after issuing notice to the petitioner and other necessary parties, who are interested in this case and pass an order or take appropriate action on the same on merits and in accordance with law within a period of 12 weeks from the date of receipt of a copy of this order."

4.With the above observation, the Writ Petition is disposed of. No costs. Consequently, the connected miscellaneous petition is closed.
