The writ petition has been filed for issuance of a Writ of Mandamus, directing the respondent to grant permission and protection for cultural event namely Innisai Katcheri performed by disabled persons scheduled to be held on 07.07.2016 at night in connection with Mandala Poojai at Arulmugu Sri Pappathiammal Parameswari Swamy Thirukovil at Puduvidhuthi, Ragunathapuram Village, Karambakudi Taluk, Pudukkottai District by considering the petitioner's representation dated 17.06.2016. 2.Mr.D.Muruganandam, learned Additional Government Pleader, takes notice for the respondent. By consent, the writ petition itself is taken up for final disposal.

3. Heard the learned counsel appearing for the petitioner and the learned Additional Government Pleader appearing for the respondent.

4. The learned counsel appearing for the petitioner would submit that the programme is being conducted by the villagers regularly in order to promote harmony during the above said festival period. He would further submit that the petitioner has already given a representation to the respondent, but the same was not considered so far. 5.The learned Additional Government Pleader appearing for the respondent would submit that on an earlier occasion, there was an untoward incident and in respect of which, a case has been registered in Crime No.47 of 2015 under Sections 143 and 188 IPC and therefore, the authorities did not grant permission.

6.However, the reasons alleged may not exist as of now and as the situation is liable to change, the petitioner is permitted to make a fresh representation.

7.Accordingly, the petitioner is directed to make a fresh representation to the respondent and on receipt of the same, the respondent is directed to consider the same and pass appropriate orders on merits and as per law.

8.With the above direction, the Writ Petition is disposed of. No costs.
