To call for records and set aside the Judgment dated 30.10.2023 in C.A.No.71 of 2021 on the file of the Learned Principal District and Sessions Judge, Virudhunagar District at Srivilliputhur by confirmingthe order of conviction dt.23.04.2021 in C.C.No. 268 of 2020 passed by the Learned Fast Track judicial Magistrate, Srivilliputhur for the offence punishable under section 138 of NI Act and allow this Criminal Revision.

Order : This Criminal Miscellaneous Petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of M/S.SASIKUMAR.V, Advocate for the petitioner and of MR.R.VIDHYA, Advocate on behalf of the Respondent, the court made the following order:- This petition has been filed to relax the condition imposed on the petitioner in Crl.M.P(MD).No.16676 of 2023 in Crl.R.C(MD)No.1309 of 2023 dated 28.11.2023.

2. The learned counsel for the petitioner and learned counsel appearing for the respondent are present before this Court.

3. The learned counsel for the petitioner submitted that due to the petitioner's health condition, the petitioner unable to comply with the condition imposed by this court regularly.

4. Considering the health condition of the petitioner, the condition imposed by this court in Crl.M.P(MD).No.16676 of 2023 in Crl.R.C(MD)No.1309 of 2023 dated 28.11.2023 is relaxed and the petitioner shall report before the concerned trial Court as when required of interrogation.
