O R D E R

The writ petition has been filed for issuance of a Writ of Mandamus, directing the respondent to give permission to conduct Adal Padal Programme in the event of festival of Kovakkulam Sree Mariamman Kovil at Kovakkulam & Post, Krishnarayapuram Taluk, Karur District on 11.07.2016.

2. Mr.D.Muruganandam, learned Additional Government Pleader, takes notice for the respondent. By consent, the writ petition itself is taken up for final disposal.

3. Heard the learned counsel appearing for the petitioner and the learned Additional Government Pleader appearing for the respondent.

4. The learned counsel appearing for the petitioner would submit that the programme is being conducted by the villagers regularly in order to promote harmony during the above said festival period; that a representation was given to the respondents, but, however, the same was not considered by the respondents so far and hence, the petitioner is before this Court with this writ petition. The learned counsel appearing for the petitioner would further submit that as the aforesaid festival is celebrated in a peaceful manner by the villagers, there will be no untoward incident on account of this celebration. https://hcservices.ecourts.gov.in/hcservices/ 5.The learned Additional Government Pleader appearing for the respondent would submit that on an earlier occasion, there was an

untoward incident and in respect of which, a case has been registered in Crime No.125 of 2014 under Sections 302, 376, 379 IPC and also under Sections 5, 6 and 7 of the Protection of Children from Sexual Offences Act, 2012 and therefore, the authorities did not grant permission. 6.However, the reasons alleged may not exist as of now and as the situation is liable to change, the petitioner is permitted to make a fresh representation.

7.Accordingly, the petitioner is directed to make a fresh representation to the respondent and on receipt of such representation, the respondent is directed to consider the same and pass appropriate orders on merits and as per law.

8.With the above direction, the Writ Petition is disposed of. No costs.
