(R2 is suo motu impleaded vide Court order dated 19.07.2023 in W.M.P.(MD).No.13378 of 2023) PRAYER : Writ Petition is filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus, to call for the records pertaining to the RFL/MURAPPANADU/11/2023, dated 06.06.2023, (impugned order) of the respondent and quash the same as illegal and exercising the power arbitrarily and mala fide in the eyes of law and consequently, direct the respondent to register the power deed, to be executed by the petitioner in favour of Selvam S/o.Paramasivan forthwith.

ORDER

The present Writ Petition has been filed to quash the impugned order passed by the 1st respondent in RFL/MURAPPANADU/11/2023, dated 06.06.2023, and consequently, to direct the respondent to register the power deed, to be executed by the petitioner in favour of Selvam S/o.Paramasivan forthwith. 2.The contention of the petitioner is that the first respondent have refused to register by citing that the property belongs to one Seevalaperi Sathiram. However, he relied on another proceedings issued by the Zonal Deputy Thasildhar, Srivaigundam, to the petitioner in O.Mu.A9-10569/2022, dated 14.12.2022, wherein, it is stated that the said property does not belong to the above said Sathiram. Therefore, the impugned order is liable to be quashed. 3.Accordingly, this writ petition stands allowed. The impugned order passed by the 1st respondent in RFL/MURAPPANADU/11/2023, dated 06.06.2023, is hereby quashed. The first respondent is directed to issue notice to the petitioner and consider the petitioner's case in the light of the information 2/4

issued O.Mu.A9-10569/2022, dated 14.12.2022. The said exercise shall be completed within a period of six weeks from the date of receipt of a copy of this order. No costs.
