PRAYER :- To enlarge the petitioner/accused on bail in connection with case in S.C.No.22/2016 on the file of the Principal Sub Court, Karur in Cr.No.37/2015 pending investigation on the file of the respondent Police.
ORDER : The Court made the following order :- The petitioner/A3 herein was arrested and remanded to judicial custody on 20.04.2023 for the alleged offence under Section 392 of IPC in Crime No.37 of 2015 on the file of the respondent police seeks bail.
2. Earlier the petitioner was arrested and released on bail. Thereafter the petitioner did not appear before the trial Court , hence Non Bailable Warrant was issued on 01.07.2016. The petitioner was arrested on execution of Non Bailable Warrant on 20.04.2023.
3. It is seen that the trial is pending from the year 2016 and after examination of P.W.1 to P.W.6 the petitioner was not present before the Court and as such Non Bailable Warrant was issued as against the petitioner on 01.07.2016. Thereafter the respondent secured the petitioner on 20.04.2023 and remanded him to judicial https://www.mhc.tn.gov.in/judis 1/2
CRL OP(MD). No.10567 of 2023 custody. If the petitioner is released on bail he will abscond again and the entire trial will be stalled, therefore this Court is not inclined to grant bail to the petitioner.
4. Hence the petition stands dismissed.
