ORDER

The present writ petition is filed for a mandamus to pay the fair compensation, for acquiring a portion of the petitioner's land in S.No.8/13A, in Ethikudi Village, Silukkpatti Group, by disposing the petitioner's representation dated 25.04.2025.

2. The learned Additional Government Pleader appearing for the respondents would submit that admittedly there is a road in the land comprised in S.No.8/13A at Ethikudi Village, Silukkpatti Group. But the petitioner claims to be in possession of the portion of the above said subject land. Therefore, unless a survey is conducted the issue cannot be sorted out.

3. By way of rejoinder, the learned counsel appearing for the petitioner would submit that a channel has also been created in the petitioner's land.

4. Considering the facts and circumstances, the 3rd respondent is directed to survey the land, earmark the boundaries of the petitioner's portion of the subject land. If the said portion is acquired and a channel has been created, the petitioner is entitled to compensation and the same shall be calculated as per the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013. The said exercise shall be completed within a period of twelve (12) weeks from the date of receipt of a copy of this order.

5. The writ petition stands disposed of with the above observations. No costs.
