O R D E R

This Writ Petition has been filed for issuing direction to the 1st respondent to give suitable instruction to the 2nd respondent to take necessary action based on the petitioner's representation dated 01.12.2023.

2. The learned Additional Public Prosecutor appearing for the respondents would submit that on the basis of the earlier complaint given by the petitioner enquiry was undertaken in CSR.No.283 of 2022 and during the course of enquiry, both sides appeared and the counter party gave an undertaking that he will repay the amount and settle the issue on or before 30.11.2022 and the petitioner also accepted the above said undertaking and on that account the said complaint was closed.

3. Now, the grievance of the petitioner is that the above said undertaking was not complied by the private party and hence, he has given a fresh representation before the 2nd respondent.

4. Since the earlier complaint given by the petitioner was 2/4

closed on the basis of the compromise reached between the parties, the representation given by the petition is not maintainable. Even though the Writ Petition does not lie, the petitioner is given liberty to give a fresh complaint to the 2nd respondent. On receiving the said complaint, 2nd respondent is directed to consider the same within a period of fifteen days, on its own merits by following the proper procedure.

5. With the above direction, this Writ Petition is disposed of. No cots.
