PRAYER : Criminal Original Petition filed under Section 482 Cr.P.C, to call for the records in the First Information Report in Manachanallur Police Station Crime No.144 of 2019 and quash the same.

O R D E R

This criminal original petition has been filed, invoking Section 482 Cr.P.C., to call for the records in Crime No.144 of 2019 and quash the same.

2.When the matter was taken up for hearing on 21.12.2021, the petitioner appearing party-in-person has filed a copy of the final report and also the order passed by the learned Judicial Magistrate, accepting the final report and granting liberty to the defacto complainant to file a private complaint if any within two months. At that juncture, the learned counsel for the defacto complainant sought time for getting instructions.

3.When the matter is taken up for hearing today (20.01.2022), the learned counsel for the 10th respondent/defacto complainant would submit that the defacto complainant has received the RCS notice.

4.It is evident from the order passed by the learned Judicial Magistrate that after service of notice, the defacto complainant has entered into appearance and at his instance, the matter was adjourned for his objections, but after taking some adjournments, he has not turned up nor filed his objections. Thereafter, the learned Judicial Magistrate, has passed an order dated 14.10.2020, accepting the final report and gave liberty to the defacto complainant to file a private complaint, if any within two months. 5.As rightly contended by the petitioner and the learned Government Advocate (Criminal side), since the negative report was accepted by the learned Judicial Magistrate, nothing survives for further adjudication.

6.Recording the above, this criminal original petition is dismissed as infructuous. Consequently, connected miscellaneous petition is closed.
