PRAYER : Writ petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus directing the respondents to disburse the assured sum along with vested bonus in respect of the petitioner's son A.Dineshkumar's Life Insurance Policies viz., 1.Jeevan Lakshaya in Policy No.758185504 for a sum of Rs.13,50,000/-, 2.Endowment Assurance Policy No.756778711 for a sum of Rs.10,00,000/-, 3. Jeevan Anand in Policy No.756788350 for a sum of Rs.10,00,000/- and 4. Jeevan Anand in Policy No.756788351 for a sum of Rs.10,00,000/- to the petitioner by considering his representation dated 08.11.2017.

By consent, the writ petition itself is taken up for final disposal.

2. Notice to the respondents is dispensed with, as no adverse order is going to be passed against them.

3. According to the petitioner, his son, who died on 25.02.2016, took four Life Insurance Policies, with the second respondent, in his name, which are as follows: i) Jeevan Lakshaya in Policy No.758185504 for a sum of Rs.13,50,000/-;

ii) Endowment Assurance Policy No.756778711 for a sum of Rs.10,00,000/-;

iii) Jeevan Anand in Policy No.756788350 for a sum of Rs.10,00,000/-; and iv) Jeevan Anand in Policy No.756788351 for a sum of Rs.10,00,000/-.

After the demise of his son, the petitioner, being the nominee, has submitted a representation dated 08.11.2017 before the authorities requesting them to disburse the sum assured along with vested bonus. As the said representation is kept pending, without any action, he is before this Court.

4. When the matter is taken up for hearing today, the learned Counsel for the petitioner submitted that it would be suffice, if the representation of the petitioner dated 08.11.2017, is disposed of by the respondents, on merits.

5. Considering the facts and circumstances of the case and also the limited scope of the relief sought for, this Court, without going into the merits of the claim, directs the respondents to consider the representation of the petitioner dated 08.11.2017 and pass appropriate orders, on merits and in accordance with law, after affording due opportunity of hearing to the petitioner and all the other interested parties, if any, within a period of six weeks from the date of receipt of a copy of this order.

6. With the above direction, this writ petition is disposed of. No costs.
