Degree Course in Mathematics discipline with the respondents university based on the petitioner's selection through the counselling communication dated 16.07.2016 without insisting the production of community certificate to the category of Hindu Malaivedan ST community and permit the petitioner to produce the Hindu Malaivedan ST community certificate as and when the competent authority issued to the petitioner.

ORDER

(Order of the Court was made by NOOTY.RAMAMOHANA RAO,J) The student community keeps raking up the issue relating to the production of their social status claim certificate as it truly keeps coming in their way for prosecuting higher education. The standard plea was that the competent authority who is required to grant certificate does not grant certificate in time. But however, there is also a criticism that seats meant for scheduled castes, scheduled tribes, backward classes and most backward classes are sought to be cornered by those who do not fall in the respective classes or categories and consequently, they will be depriving the genuine students belonging to the said community from securing admission against the reserved quota of seats to the full. https://hcservices.ecourts.gov.in/hcservices/

2.We are required to balance both sides of these competing claims and hence, while granting direction to the respondents to grant admission to the writ petitioner in the first year B.Sc. Degree course which is only of three years duration, the following condition may be incorporated therein namely:- The writ petitioner shall produce his social status certificate vouching that he belongs to the community to which he has claimed as belonging before the end of first year/II semester examination for the B.Sc., Degree course, is held. If the petitioner does not produce any such certificate, he shall not be permitted to appear for the said examination and he shall be discontinued. The petitioner shall also produce income certificate, at the earliest. 3.With the above direction, the writ petition is disposed of. No costs.
