ORDER

This Criminal Original Petition has been filed to quash the proceedings in C.C.No.305 of 2017 on the file of the learned Judicial Magistrate, Fast Track Court, Magistrate Level Thoothukudi, Thoothukudi District.

2.The petitioners are the accused in a complaint filed under Section 138 of Negotiable Instruments Act, by the respondent. 3.The learned counsel for the petitioners would submit that the cheque amount is only for a sum of Rs.30,000/- and there is a possibility of settlement between the parties. 4.If there is a real possibility of settlement between the parties, the petitioners can make the same request before the Court below in order to settle the matter. The C.C is of the year 2017 and the case is pending before the Court below at the stage of trial. Therefore, it is open to the petitioners to make a request before the Court below to refer the matter before Mediation and Conciliation Centre for settlement, if really the petitioners intend to settle the matter with the complainant.
