ORDER

Heard learned counsel for the petitioner, learned Additional Government Pleader for the first respondent and Government Advocate (Crl.Side) for the second respondent.

2. After hearing the learned counsel for the petitioner and learned Additional Government Pleader for the first respondent and Government Advocate (Crl.Side) for the second respondent, this Court is of the view to dispose of this Writ Petition in the light of the decision of the Division Bench of this Court in P.Sethuraman Vs. The Licensing Authority, Dindigul reported in [2010] WLR 100, which has been followed by this Court in several cases including in the case G.Ravi vs. The Regional Transport Officer, Dindigul and another in W.P.(MD) No.9525 of 2024 (decided on 17.04.2024).

3. In view of the above, the second respondent is directed to return the licence, that was seized from the petitioner on account of registration of an FIR in Crime No.382 of 2024 before the Karur Town Police Station, immediately. 2/4

4. The first respondent shall endeavour to issue show cause notice and proceed to pass appropriate order on merits and in accordance with law as expeditiously as possible. The petitioner shall co-operate with the respondents and shall surrender the licence in case adverse orders are passed by the first respondent in the proposed notice.
