Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the respondents to remove the waiting shed constructed for the burial ground from the petitioners patta land in Survey No.231/3C, situated at Pannamparai Village, Sathankulam Taluk, Tuticorin District, and shift the same to the adjacent Poramboke land in Survey No.429/3B, in

accordance with the proceedings of the 3rd respondent in Na.Ka. A2/119/2025 dated 31.07.2025 and 08.01.2026, within a time frame as fixed by this Honble Court, and consequently restore the petitioners property to its original condition and pass such further or other orders as this Honble Court may deem fit and proper in the circumstances of the case and thus render justice.

ORDER

The present writ petition has been filed for the following relief:- "Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the respondents to remove the waiting shed constructed for the burial ground from the petitioners patta land in Survey No. 231/3C, situated at Pannamparai Village, Sathankulam Taluk, Tuticorin District, and shift the same to the adjacent Poramboke land in Survey No.429/3B, in accordance with the proceedings of the 3rd respondent in Na.Ka. A2/119/2025 dated 31.07.2025 and 08.01.2026, within a time frame as fixed by this Honble Court, and consequently restore the petitioners property to its original condition and pass such further or other orders as this Honble Court may deem fit and proper in the circumstances of the case and thus render justice."

2. Head Mr.V.Karthick Raja, learned counsel appearing for the petitioner and Mr.R.Parthiban, learned Government Advocate, who takes notice on behalf of the respondents 1 to 3.

The case of the petitioner is that the waiting shed was wrongly located in Survey No. 231/3C, situated in Pannamparai Village, Sathankulam Taluk, Tuticorin District, which belongs to the petitioner. Instead of constructing the waiting shed on the adjacent poramboke land in Survey No. 429/3B, it was erroneously constructed in the petitioner's land.

4. When the matter came up for admission, the learned Government Advocate appearing on behalf of respondents 1 to 3 submitted that a field inspection had already been conducted and that the Tahsildar had directed the Block Development Officer to remove and relocate the waiting shed. He further submitted that the said direction would be duly carried out.

5. Recording the same, the writ petition is disposed of with a direction to the 4th respondent to relocate the waiting shed within a period of eight weeks from the date of receipt of a web copy of the order. No costs.
