PRAYER : Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Certiorarified Mandamus, to call for the records pertaining to the impugned refusal check slip in No.RFL/Sethur/32/2024 on the file of the respondent dated 20.05.2024 and to quash the same as illegal and consequently, to direct the respondent to receive and register the certified copy of Lok Adalat award passed in L.A.3/2024 organized by Virudhunagar District Legal Services Authority, Srivilliputhur dated 06.02.2024 in respect of the petitioner's properties comprised in Survey Nos.149/3, 149/4B, 105/3, 103/18, 363/191, 363/189, 104/2B, 105/9 located in Sethur Village, Virudhunagar District, within the time stipulated by this Court. .

ORDER

The present Writ Petition has been filed for the issuance of a Writ of Certiorarified Mandamus, to quash the impugned refusal check slip in No.RFL/Sethur/32/2024 on the file of the respondent dated 20.05.2024 and consequently, direct the respondent to receive and register the certified copy of Lok Adalat award passed in L.A.3/2024 organised by Virudhunagar District Legal Services Authority, Srivilliputhur, dated 06.02.2024. 2.The contention of the petitioner is that the land originally belonged to his father. The petitioner filed a civil suit in O.S.No.587 of 2023 on the file of Sub Court, Srivilliputhur against his three sisters and obtained a Lok Adalat award, dated 06.02.2024, wherein the properties were settled in his favour. When the petitioner submitted the Lok Adalat award before the respondent for registration, the respondent refused to register the same stating that the land belongs to a Karuppasamy Temple.

3.When it is a temple land, the 1st respondent is bound to conduct enquiry by calling the petitioner as well as temple and then pass orders as per the order passed in the case of Sudha Ravi Kumar and Another Vs. The Special Commissioner and Others in W.P.Nos.30589 of 2013 and batch, dated 05.04.2017.

4.Therefore, the respondent is directed to conduct an enquiry and pass orders in accordance to law.

5.With the above observations, this Writ Petition is disposed of. There shall be no order as to costs.
