O R D E R
The writ petition has been filed for issuance of a Writ of Mandamus, directing the respondents 1 to 3 herein to grant permission and adequate protection to conduct "108 Perumal Divya Dharsan" exhibition to be held on 15.07.2016 to 24.07.2016 at scheduled time 7.00 a.m. to 9.00 p.m. at Pioneer Muthu Theatre, Avvai Shanmugam Road, Ozhuganassery, Nagercoil, Kanyakumari District, on the basis of the petitioner's representation dated 23.06.2016.
2.Mr.D.Muruganandam, learned Additional Government Pleader, takes notice for the respondents. By consent, the writ petition is taken up for final disposal at the stage of admission itself. 3.Heard the learned counsel appearing for the petitioner and the learned Additional Government Pleader appearing for the respondents.
4.The learned counsel appearing for the petitioner would submit that "108 Perumal Divya Dharsan" exhibition is being conducted for the public to gain blessings under one roof; the petitioner, after getting consent from the proprietor of Pioneer Muthu Theatre, Avvai Shanmugam Road, Ozhuganassery, Nagercoil, Kanyakumari District, and "no objection certificate" from the Assistant District Officer, Fire and Rescue Services, Kanyakumari District at Nagercoil, approached the third respondent in person and submitted an application, dated 14.03.2016, seeking permission to conduct such exhibition. As the same was not considered by the respondents, the petitioner has sent a representation to the respondents requesting them to grant permission to conduct exhibition. As there was no response to the same, the petitioner has come up with for the aforesaid prayer.
5.The learned Additional Government Pleader appearing for the respondents, on instructions, gave an undertaking that the third respondent would consider the representation of the petitioner dated 23.06.2016 and pass appropriate orders on merits and in accordance with law.
6.In view of the above submission made by the learned Additional Government Pleader, the third respondent is directed to consider the representation of the petitioner dated 23.06.2016 and pass appropriate orders on merits and in accordance with law forthwith, as the programme is scheduled to be held on 15.07.2016.
7. With the above direction, the Writ Petition is disposed of. No costs.
