Prayer: Writ Petition filed under Article 226 of the constitution of India, to issue a writ of Mandamus, directing the first respondent herein to dispose of the revision in Na.Ka.No.42017 of 2015 against the order passed by the Revenue Divisional Officer, Madurai in Na.Ka.No.1389/2014, dated 22.07.2015 within a time frame that may be stipulated by this Court.

By consent, the writ petition is taken up for final disposal at the stage of admission itself.

2. Mr.T.S.Mohamed Mohideen, learned Additional Government Pleader takes notice for the first respondent. Notice to the second respondent is dispensed with, as no adverse order is going to be passed against him.

3. According to the petitioner, the subject mentioned property belongs to her father and after the demise of her father, the second respondent, creating some forged documents has obtained patta in his name. Aggrieved thereby, the petitioner has preferred an appeal before the Revenue Divisional Officer, who, in turn, after a detailed enquiry has passed an order dated 22.07.2015, in favour of the petitioner. Challenging the same, the second respondent has filed a revision before the first respondent in Na.Ka.No.42017 of 2015. It is the grievance of the petitioner that pending revision proceedings, the second respondent has simultaneously filed a suit, in order to drag on the proceedings. Hence, the petitioner is before this Court, seeking a direction for early disposal of the revision, pending before the first respondent.

Considering the facts and circumstances of the case and also the limited scope of the relief sought for, this Court, without going into the merits of the claim, directs the first respondent to dispose of the revision of the petitioner in Na.Ka.No.42017 of 2015, on merits and in accordance with law, after affording due opportunity of hearing to the petitioner and the second respondent as well as all the other interested parties, if any, within a period of eight weeks from the date of receipt of a copy of this order.
