Prayer: Writ Petition filed under Article 226 of the constitution of India, to issue a writ of Mandamus, directing the first respondent to issue Adangal certificate to the petitioner and consequently directing the second respondent to receive the premium amount from the petitioner under the Prime Minister Crop Failure Insurance Scheme.

By consent, the writ petition is taken up for final disposal at the stage of admission itself.

2. Mr.M.Alagathevan, learned Special Government Pleader takes notice for the first respondent. Notice to the second respondent is dispensed with, as no adverse order is going to be passed against him.

3. According to the petitioner, he is doing agricultural activities in his patta lands. He has also registered himself under crop insurance scheme and was regularly paying the premium, without any fail, in the previous years. In order to register his name, with the second respondent, in the said scheme for the year 2016-17, the petitioner has sought for Adangal Certificate from the first respondent and because of his inaction, he is before this Court. https://hcservices.ecourts.gov.in/hcservices/

4. It is the specific contention of the learned Counsel for the petitioner that because of the non-availability of the Adangal Certificate, he was not able to register himself, with the second respondent, within the due date.

5. The learned Special Government Pleader, on instructions, submitted that as the Sub-Collector, Paramakudi by order dated 30.11.2016, has directed not to disburse the compensation amount to the petitioner, the authorities had rejected his claim for Adangal Certificate.

6. In reply to the same, the learned Counsel for the petitioner submitted that the said order is under challenge before this Court in W.P(MD)No.4955 of 2017 and the same is pending.

7. Heard both sides and perused the documents placed on record.

8. Be that as it may, this Court is of the considered view that the petitioner has sought for the Adangal Certificate alone and the same is having nothing to do with the pending proceedings.

9. Under such circumstances, the first respondent is hereby directed to issue Adangal Certificate to the petitioner, within a period of six weeks from the date of receipt of a copy of this order, on payment of necessary fee, if not already paid. On receipt of the same, it is open to the petitioner to approach the authority concerned for appropriate relief. No costs.
