Prayer: Writ Petition filed under Article 226 of the constitution of India, to issue a writ of Mandamus, directing the respondents herein to transfer / issue patta in favour of the petitioner by making necessary changes in the revenue records such as Chitta etc., to extent the 1.50 acres in S.No.465/1-A situated at Sooriyur Village, Trichy Taluk within the time limit fixed by this Court. By consent, this writ petition is taken up for final disposal, at the stage of admission itself.

2. Heard the learned Counsel for the petitioner and Mr.T.S.Mohamed Mohideen, learned Additional Government Pleader, who takes notice for the respondents.

3. The petitioner, who is a Ex-Serviceman, is before this Court and according to him, the subject mentioned property was assigned to him by the authorities, after following due process of law. Whereas, the patta stands in the name of some third party, viz., its previous owner. In order to get the patta transferred in his name, the petitioner has submitted several representations before the authorities and despite remittance of necessary fee, no fruitful https://hcservices.ecourts.gov.in/hcservices/

results have been yielded yet. Aggrieved over the same, he is before this Court.

4. When the matter is taken up for hearing today, the learned counsel for the petitioner submitted that it would be suffice, if his representation is disposed of, by the fourth respondent, as per law, within a stipulated time limit.

5. Considering the facts and circumstances of the case and also the limited scope of the relief sought for, this Court, without going into the merits of the petitioner's claim, directs the respondents, more particularly the fourth respondent, to look into the issue and pass appropriate orders with regard to transfer of patta, on its own merits and in accordance with law, after affording due opportunity of hearing to the petitioner as well as all the other interested parties, if any, within a period of eight weeks from the date of receipt of a copy of this order.
