ORDER

This writ petition is filed for a mandamus directing the third respondent to issue Chanda receipt to the petitioner and issue Nikkah Daftar and all necessary certificates for the performance of the petitioner's daughter's marriage, which is scheduled to be held on 21.05.2026. 2.Upon hearing the learned counsel for the petitioner and producing the material records of the case, it is the case of the petitioner that when the petitioner approached for payment of Chanda and for carrying out the necessary formalities with reference to the petitioner's daughter's wedding, the same is not accepted on the ground that it is only the petitioner's brother alone who has paid the Chanda. It is the further apprehension of the petitioner that merely because he has raised certain dispute with reference to the management of the mosque, he has been unnecessarily dragged on.

3.When the matter came up for admission, the learned counsel took notice on behalf of respondents 1 to 3. Since the prayer is with reference to the marriage of the daughter of the petitioner, I am of the view that the same can be acceded to by the 3rd respondent as it is positively stated that the petitioner is residing in the concerned Mohalla within the said Waqf, viz., Manambuchavadi, Muslim Street, Mosque. Even if there are any other disputes, the same need not be brought in at the time of the marriage. 4.In view thereof, this writ petition is ordered on the following terms: (i)The third respondent is directed to receive the contribution and issue Chanda receipt in the name of the petitioner and issue Nikkah Daftar facilitating the due performance of the petitioner's daughter marriage scheduled to be held on 21.05.2026.

(ii)The Chanda receipt and the other procedure formality shall be completed within a period of 10 days from the date of receipt of the web copy of the order.

(iii)Even if the third respondent has any objection with reference to the petitioner being the member of the waqf, the same can be considered later for the purpose of voting etc., but at this juncture, when the petitioner wants to perform his daughter's wedding in the religious manner, the same need not be raised.

(iv)No costs. Consequently, connected miscellaneous petition is also closed.
