:Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus directing the respondents 1 to 3 to consider the petitioner's representation dated 06.05.2023.
For Petitioner :Mrs.S.Devasena For Respondents : Mr.A.Oliraja Government Advocate
O R D E R
The prayer in the writ petition is to direct the respondents 1 to 3 to consider the petitioner's representation dated 06.05.2023.
2. The learned counsel appearing for the petitioner would submit that the stepmother of the petitioner, who maintained account with the third respondent Society passed away in the year 2018, leaving behind the petitioner and her sister as legal heirs. In order to verify the bank account statement, the petitioner has made an application before the third respondent. Though the application was made in this regard on 06.05.2025 the respondents have not furnished the copy of the bank statement to the petitioner.
3. The learned Government Advocate appearing for the respondents would submit that there is a dispute among the sisters and a suit is pending before the civil Court, thereby they are unable to give bank statement to the petitioner alone and if any direction is issued by this Court, they are ready to provide the bank statement.
4. It is seen that the stepmother of the petitioner is having account with the third respondent Society and the petitioner and her sister are the legal heirs. There is a dispute between the petitioner and her sister and a suit is also pending before the civil Court. Now, the petitioner has applied for certified copy of the bank statement of her stepmother. Production of certified copy of the bank statement will not amount to depriving the right of the petitioner's sister.
5. Accordingly, this Court directs the third respondent Society to furnish the certified copy of bank account statement of the petitioner's stepmother within a period of one month from the date of receipt of a copy of this order.
6. It is made clear that by virtue of this order the petitioner shall not claim any other right. In the event if the sister of the petitioner made any similar application for certified copy of the bank account statement for the same account, the third respondent Society is directed to furnish the same. The money deposited in the account of the petitioner's stepmother can be withdrawn by the petitioner herein and her sister, once their rights are decided by the Civil Court.
7. With the above direction, the Writ Petition stands disposed of. 16.12.2025 NCC :Yes/No Index:Yes/No Internet:Yes/No aav To
