ORDER : The Court made the following order :- The petitioner/Accused, who apprehends arrest at the hands of the respondent police for the offences punishable under sections 120(B), 406 and 420 of IPC and Section 5 of TNPID Act & 21(1), 21(2), 21(3), 22, 23 of the Banning of Unregulated 1/4
Deposit Schemes Act, 2019, in Crime No.1 of 2024 on the file of the respondent police, seeks anticipatory bail.

The case of the prosecution is that the petitioner, along with other accused, runs the company in the name and style of True Way Services (P) Ltd, in which Accused No.9 is the Chairman and Accused No.10 is the Managing Director. They introduced several schemes, canvassed the public, collected a huge amount, and assured that they would refund the amount with interest or would give a property worth for the same value. As such, the defacto complainant totally invested Rs.25,00,000/- on 06.11.2023 and 24.01.2024 respectively. Later, he received Rs.80,000/- in two months and since the month of February 2024, he has not received any amount, as they cheated him. Hence, a case has been registered.

The learned counsel appearing for the petitioner submits that the petitioner is one of the investors and he deposited a sum of Rs.25,00,000/- in Trueway Business Services Private Limited and introduced several depositors to the said company and periodical returns are also made promptly till December, 2023. Thereafter, he came to know that the company misappropriated the amount deposited by depositors, and hence, he lodged a complaint against the company on 25.08.2024. He would further submit that the petitioner is an innocent person and he has nothing to do with the alleged offence. Based on the confession of Accused 2/4
Nos.9 and 10, the petitioner has been falsely implicated in this case. Hence, he seeks anticipatory bail to the petitioner.
4. The learned Government Advocate (Crl.side) appearing for the respondent police submits that the petitioner is arrayed as Accused No.18 after the alteration report. Based on the confession of Accused Nos.9 and 10, the petitioner received a sum of Rs.1,32,15,000/- from 31 depositors. He would further submit that 445 victims have lodged complaints and the total amount involved in this case is Rs.18,85,21,336/-, so far, 37 properties have been identified worth Rs.1,86,31,554/-. He would further submit that Accused Nos.10 and 16 were already arrested and released on bail and Accused Nos.11 and 12 anticipatory bail petitions are pending before this Court. Hence, he strongly objected to grant anticipatory bail to the petitioner.
5.Taking into consideration of the above facts and circumstances of the case and also the fact that the petitioner alleged to have been received Rs.1,32,15,000/- from 31 depositors and also taking note of the fact that a huge amount is involved in this case, and hence, custodial interrogation of the petitioner is very much required in this case, this Court is not inclined to grant anticipatory bail to the petitioner at this stage.
