ORDER
Heard the learned counsel for the writ petitioner, the learned Government Advocate appearing for the respondents 1, 3 & 5 and the learned Government Advocate (Criminal Side) appearing for the respondents 2 & 4. Considering the nature of relief to be granted, issuance of notice to the sixth respondent is dispensed with.
2.The petitioner alleges that illicit removal of gravel had taken place in Sirukoodalpatti village, Pillaiyarpatti. According to him, the sixth 2/5
respondent had committed the offending acts. Representation was given on 09.10.2025. Since no action was taken, this writ petition came to be filed. 3.After hearing the learned counsel on either side, we are of the view that the materials placed on record are not sufficient to arrive at even a prima facie conclusion against the sixth respondent. Except for a bare representation and photographs, no other material has been placed before us. 4.The learned Government Advocate submitted that as early as on 21.07.2020, the District Collector had granted permission to the trustees of the Pillaiyarpatti temple to remove 90 cubic metres of gravel. He would further submit that the writ petitioner and the sixth respondent are ill-disposed to each other and that the present Public Interest Litigation is a fallout of their personal dispute.
5.In these circumstances, we are not in a position to grant any positive direction as such. However, it is for the District Collector, Sivagangai District to look into the writ petitioner's representation and take appropriate remedial action, if he deems fit. We make it clear that no contempt proceedings shall arise out of this order.
