ORDER

The petitioner has filed this Writ Petition seeking for a Writ of Mandamus directing the respondent to allow the petitioner to participate the preliminary examination on 13.07.2024 for the Notification No. 04/2024 dated 28.03.2024 for posts included in combined Civil Services Examination - I (Group-1 Services) 2024 and accept the petitioner's manual exam application by considering the petitioner's representation dated on 03.05.2024 within the time stipulated by this Court.

2. Heard Mr.G.Sakthi Rao, learned counsel for the petitioner and Mr.J.Anandkumar, learned counsel for the respondent.

3. By consent of both parties, this Writ Petition is taken up for final disposal at the stage of admission itself.

4. The learned counsel appearing for the petitioner submitted that since the petitioner was in a serious health condition and he was 2/6

admitted as in-patient in the hospital on 28.03.2024 and discharged on 26.04.2024, he was not able to apply for the aforesaid post on or before the last date of the examination through online, which fell on 03.05.2024. The petitioner sent a representation to the respondents to allow him to appear for the examination. Since he has not been allowed to appear for the examination, he filed this writ petition.

5. On perusal of the materials available on record, it is seen that the petitioner has not applied for the aforesaid post and he has lost his opportunity to appear for examination. As he had not applied to the post due to his health reasons, no lenience can be shown. If everyone expects such lenience for some reasons or other, there cannot be any certainty or timeline for the recruitment.

6. Admittedly, when the notification for conducting examinations to certain posts, the last date of applying for the examination is announced. The petitioner ought to have applied earlier, either directly or through some other person. There are some rules and regulations to conduct the examination for the posts to be filled up and the rules have 3/6

to be strictly followed in order to ensure uniformity. The rules cannot be relaxed for the petitioner alone.

7. In view of the aforesaid observations, I find no merit in this case and hence, this writ petition is dismissed. No costs. 01.07.2024 Index : Yes / No Internet : Yes / No NCC : Yes / No sm 4/6
