ORDER
This Court has passed an order on 22.06.2022, in which the the prayer for Writ of Mandamus seeking a direction to the respondent to permit 83 students to write first semester examination of the B.Ed., 1/4
Course and publish the results for the academic year 2021-2022 was dismissed. Now, the Review Application has been filed by the petitioner Institution citing that though the application for continuation of the affiliation was filed beyond the cut off date on 10.12.2021, the syndicate has got powers to condone the said delay and approve the admission of the students. The counsel for the review petitioner cited the orders passed in a batch of writ petitions in W.P.No.4491 of 2022 and others dated 06.07.2022. Hence, he seeks permission of this Court to approach the syndicate for seeking condonation of the delay and get approval of the admission of 83 students. However, the learned Counsel for the respondent contended that there is no power for the syndicate to condone the delay, when an application for affiliation and approval of admission is presented beyond the cut off date. The request of the petitioner and the objection raised by the respondent University are given anxious consideration.
2. This Court, has passed an order on merits that the petitioner Institution may not be eligible to get a direction for affiliation and admission of the students. However, if it is within the powers of the syndicate, and the syndicate so desires, then the syndicate is always entitled to extend the continuation of the affiliation and approve the 2/4
students admitted in the academic year 2021-2022. As and when the syndicate meeting takes place, this issue shall be placed before the syndicate for its consideration. The writ petition stands disposed of with the above said observations.
3. In view of the above said observations, the Review Application stands disposed of.
4. Registry is directed to substitute this Para No.2 for paragraph No.10 in W.P.(MD)No.3775 of 2022, dated 22.06.2022 and issue a fresh order copy.
