quash the same as illegal and unconstitutional, consequently direct the respondents to disburse the petitioner's and her minor children's lawful share in the EDLI amount in respect of the deceased Andi, S/o. O R D E R

The petitioner challenges the notice dated 29.01.2026 issued by the third respondent, requiring her to produce a Legal Heir Certificate/No Objection Certificate from her father-in-law for disbursement of benefits under the Employees' Deposit Linked Insurance (EDLI) Scheme.

2. Heard the learned counsel appearing for the parties.

3. The petitioner's husband, Thiru V. Andi, who was employed as a loadman in the Kalayarkovil Taluk Warehouse, Sivagangai Region, passed away on 08.07.2025. Following his death, the petitioner, being his 2/6

wife, submitted an application seeking disbursement of the EDLI benefits. Along with the application, she furnished the Legal Heir Certificate and other required documents.

4. However, the third respondent issued the impugned notice directing the petitioner to produce a No Objection Certificate from her father-in-law, namely the father of the deceased employee.

5. The father of the deceased is not a Class-I legal heir. Therefore, insisting upon a No Objection Certificate from him for processing the petitioner's claim is unwarranted.

6. In view of the above, the impugned notice dated 29.01.2026 issued by the third respondent is unsustainable in law and is accordingly quashed. The respondents are directed to consider the petitioner's claim for EDLI benefits without insisting upon a No Objection Certificate from her father-in-law and to disburse the amount, subject to the petitioner satisfying all other requirements.

7. The above exercise shall be completed within a period of eight

(8) weeks from the date of receipt of a copy of this order.

8. There shall be no order as to costs.
