PRAYER: Petition filed under Section 24 and Order 52 of Code of Civil Procedure, to withdraw and transfer the HMOP No.35 of 2018 on the file of the Subordinate Court, Madhukulathoor, Ramanathapuram District, to the Subordinate Court, Tuticorin. For Petitioner : Mr.Ka.Raamakrishinan For Respondent : Mr.Pandian

O R D E R

The petitioner got married to the respondent on 08.03.2009. A child was born through the said wedlock. The child is with the petitioner. The respondent has filed HMOP.No.35 of 2018 before the Subordinate Court, Mudhukulathoor. Since the petitioner is based in Thoothukudi and is taking care of her young child, it is difficult for the petitioner to go Mudhukulathoor and contest the proceedings there.

2. Taking note of these factors that are in favour of the petitioner, in the interest of justice, this Court withdraws the HMOP.No.35 of 2018 from the file of the Subordinate Court, Mudhukulathoor and transfers the same to the file of the Subordinate Court, Thoothukudi.

3. This Transfer Civil Miscellaneous Petition is allowed accordingly. Consequently, connected Miscellaneous Petition is closed.
