PRAYER: Petition filed under Section 24 of the code of Civil Procedure, to withdraw the H.M.O.P.No.786 of 2018 on the file of the Additional Family Court, Coimbatore and transfer the same to the file of Family Court, Tirunelveli.

O R D E R

The petitioner got married to the respondent on 04.11.2016. The relationship between them appear to have come under strain. The respondent filed H.M.O.P.No.786 of 2018 before the Additional Family Court, Coimbatore, for restitution of conjugal rights. The revision petitioner is based in Tirunelveli and therefore, it is difficult to the revision petitioner to go over to Coimbatore to contest the proceedings there.

2.Hence, in the interest of justice, taking note of the fact that the petitioner is a woman, this Court withdraws H.M.O.P.No.786 of 2018 from the file of Additional Family Court, Coimbatore and transfers the same to the Family Court, Tirunelveli. 3.This Civil Revision Petition is allowed accordingly. The Family Court shall issue fresh summon to the respondent herein intimating him the next date of hearing. The respondent need not appear before the Family Court, Tirunelveli on all the hearings dates. He can appear through counsel except on counselling days and on those days his appearance as witness is essential. No costs. Consequently, connected miscellaneous petition is closed.
