Respondents PRAYER: Writ Petition is filed under Article 226 of the Constitution of India for the issue of a Writ of Mandamus, to direct the 1st respondent that to conclude the appeal proceedings in Appeal no.26 of 2007 on the file of the 1st respondent and to award enhancement of compensation amount for the acquirement of petitioner's lands in Survey No.87/3A, New Sub - division no.87/3A2, situating in Rajakambeeram Village, Madurai North Taluk, Madurai District within the time limit that may be stipulated by this Court.

O R D E R

This writ petition has been filed, seeking a direction to the 1st respondent to conclude the appeal proceedings in Appeal No.26 of 2007 pending on his file and award enhancement of compensation amount for acquirement of the petitioner's lands in S.No.87/3A (New Sub-Division No.87/3A2), situated in Rajakambeeram Village, Madurai North Taluk, Madurai District.

2. Mr.M.Alagathevan, learned Special Government Pleader takes notice for the respondents. By consent, the writ petition is taken up for final disposal at the admission stage itself. https://hcservices.ecourts.gov.in/hcservices/

3. The case of the petitioner is that he owned the properties in question, which were acquired by the second respondent for laying a four way track by awarding a meagre amount. Aggrieved by the same, the petitioner has preferred an appeal before the first respondent for enhancement of compensation amount in the year 2007, which has been kept pending by the 1st respondent without passing any orders thereon for quite a number of years and therefore, the petitioner is before this Court with the above prayer.

4. The learned Special Government Pleader appearing for the respondents would submit that if a reasonable time is granted to the 1st respondent, the appeal filed by the petitioner will be disposed of.

5. In view of the above submission, this Court directs the 1st respondent to dispose of the petitioner's appeal, if not already disposed of, on merits and in accordance with law within a period of six weeks from the date of receipt of a copy of this order after affording an opportunity of hearing to the petitioner.

6. With the above direction, this petition is disposed of. No costs.
