Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, to direct the second respondent, to consider the representation made by the petitioner to him dated 26.06.2022, to dispose of the proceedings under Passport Act thereby permitting the petitioner to travel abroad.

ORDER
Heard the learned counsel on either side.
2. The petitioner seeks for re-issuance of passport and he made an application to the second respondent. The petitioner apprehends that it cannot be processed because of the pendency of a criminal case.
3. The learned Additional Government Pleader appearing for the first respondent clarifies that the case registered against the petitioner is only at the F.I.R stage. Therefore, there cannot be any impediment for the second respondent to consider the application of the petitioner.
4. The second respondent is directed to process the petition mentioned application and re-issue the passport to the petitioner subject to the fulfillment of all the other formalities.

5. This Writ Petition is allowed accordingly. There shall be no order as to costs.
