ORDER

The petitioner is the sole accused in Spl.S.C.No.6 of 2022 on the file of the Principal Special Court for Exclusive Trial of Cases under POCSO Act, Thanjavur. He was tried for the offence under Section 6 of POCSO Act and Section 506(ii) IPC that he has committed sexual assault on the victim girl, aged about 17 years old. After the trial, the trial Court, by its Judgment dated 27.03.2023, found the petitioner guilty for the offence under Section 6 of POCSO Act and Section 506(ii) IPC and convicted and sentenced him as under:

Challenging the Judgment of conviction and sentence, the petitioner has 2/5

filed a criminal appeal in Crl.A.(MD)No.450 of 2023 and the same has been admitted by this Court on 19.06.2023. Along with the criminal appeal, the petitioner has filed this petition seeking to suspend the sentence imposed by the trial Court.

2. Though the petitioner has filed this petition on 15.06.2023, he has not prosecuted the case. In the meantime, the typed set of papers are made ready.

3. Since the typed set of papers are made ready, this Criminal Miscellaneous Petition is dismissed. The Registry is directed to list the matter for final disposal after four weeks under the caption "accused in jail cases".
