W.P(MD).Nos.11983 and 11984 of 2016:

Writ Petitions filed under Article 226 of the Constitution of India for the issuance of a Writ of Mandamus directing first respondent I.e.the Director of Elementary Education, Chennai to pass appropriate orders on the petitioners representation dated 11.04.2016 regarding refixation of pay on par with their Junior Tmt.C.Ponnammal and Tmt.C.Jeyalakshmi, respectively.

For petitioners : M/s.S.Visvalingam For Respondents : Mr.Aaiyaram K.Selvakumar Government Advocate COMMON ORDER Since the issue involved in all the Writ Petitions are one and the same, these matters are taken up together and disposed of, by this common order.

2. The petitioners in all these Writ Petitions are serving as Headmasters under the second respondent. The grievance of the petitioners in respect of W.P.(MD).No.11983 of 2016 is that their Junior one C.Ponnammal is getting higher pay than that of the petitioners. Similarly, in W.P.(MD).No.11984 of 2016, one C.Jeyalakshmi, who is junior to the petitioners in W.P.(MD). https://hcservices.ecourts.gov.in/hcservices/

No.11984 of 2016 is getting higher pay than of the petitioners. Stating all these facts, they made individual representations to the respondents on 11.04.2016 to set right their pay anomaly of the petitioners. Since the said representations did not evoke any response, the petitioners are before this Court.

Learned counsel for the petitioner submitted that though initially the second respondent accepted the request of the petitioners in W.P.(MD).No.11983 of 2016 and passed orders in favour of the petitioners therein, subsequently, he revisited his own order and denied such benefits stating that the competent authority to set right the pay anomaly is only the first respondent and not the second respondent.

Mr.Aaiyaram K.Selvakumar, learned Government Advocate was put on notice for the respondents.

Considering the limited prayer sought for and more particularly, the second respondent passed orders in favour of the petitioners on the subject matter and only on technicalities, he withdrew his own order, the first respondent is directed to consider the representations of the petitioners, dated 11.04.2016, on merits and in accordance with law and pass appropriate orders, within a period of four weeks from the date of receipt of a copy of this order.

6. With the above direction, all the Writ Petitions stand disposed of. No costs.
