Respondent / Respondent / Complainant Petition filed praying that in the circumstances stated therein and in the petition filed therewith the High Court may be pleased to modify the condition imposed by this Honble Court in Crl.M.P.(MD).No.4661 of 2023 in Crl.A.(MD)No.810 of 2022 dated 10.04.2023 and permit the petitioner to sign before any Police Station or Court at Coimbatore instead of respondent police station. Prayer in Crl A(MD) No.810 of 2022:
To call for the entire records connected with the proceedings of the Judgment of conviction passed by the Learned Mahile Court, Pudukottai in S.C.No.57 of 2020 dated 05.03.2022 and set aside the same and acquit the appellant from all the charges. Order : This petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of M/S.BHAGAVATH SINGH G, Advocate for the petitioner and of Mr.A.THIRUVADI KUMAR, Additional Public Prosecutor on behalf of the Respondent, the court made the following order:- (Order of the Court was made by R.SURESH KUMAR, J.) This petition has been filed to modify the conditions imposed by this Court by order dated 10.04.2023, under which the sentence was suspended, where the petitioner was directed to appear before 1/3
the respondent Police Station and sign there in the register once in a week.
2.In this context, it is the contention of the petitioner that he is from Manipur State and for work nature, he is staying at Coimbatore and doing the work. Therefore, if the condition to appear before the respondent Police Station is modified with the condition to sign in any of the Police Station in the Coimbatore City, that will helpful to him to continue his work. 3.Considering the submissions made by the learned counsel for the petitioner and after hearing the learned Additional Advocate General for the respondent, the condition made in the order dated 10.04.2023, directing the petitioner to appear before the respondent Police Station once in a week and sign there, is hereby modified to the extend that the petitioner shall continue to do the same ie., appearing before the Rathinapuri Police Station, Coimbatore City once in a week until further orders.
4.With this modification, this Criminal Miscellaneous Petition is disposed of.
