: Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India, to issue a of a Writ of Certiorarified Mandamus, to quash Clause 9 of G.O.(Ms)No.90, School Education Department dated 09.05.2018 as illegal and arbitrary and in consequence there of direct the respondents to extent the benefit of G.O.Ms.No.216, Finance (PC) Department dated 22.03.1993 to the petitioner and revises the pension and other benefits due to him in accordance with law.

O R D E R

This Writ Petition has been filed challenging Clause 9 of G.O.(Ms)No.90, School Education Department dated 09.05.2018. 2.The very same G.O. was a subject matter of challenge before the Full Bench of this Court and the Full Bench of this Court 2/6

by its order dated 09.12.2016 in Review Application No.227 of 2015, eventhough granted certain benefits, has held that the said benefits shall be extended to the parties who were before the Full Bench alone and no fresh Writ Petitions could be entertained on and from 09.12.2016. The operative portion of the said order is reproduced hereunder:

"38.Today, .....

ii) ....

iii) ....

iv) It is further made clear that the benefits as directed above, shall be extended to the parties who are before this Court alone and no fresh Writ Petitions would be entertained on and from 09.12.2016."

3.Admittedly, this Writ Petition was filed only on 25.08.2021 and therefore, as per the Full Bench judgment, referred to supra, this Writ Petition is not maintainable, since it has been filed after 09.12.2016.

4.For the foregoing reasons, there is no merit in this Writ Petition.

5.Accordingly, this Writ Petition stands dismissed. There shall be no order as to costs. Consequently, the connected miscellaneous petition is closed.
