Prayer : Criminal Original Petition filed under Section 482 of the Code of Criminal Procedure, to withdraw the enquiry on the petitioner's complaint in No.G3/23455/19/1847 on the file of the first respondent and transfer the same to CBCID, Ramanathapuram to conclude the enquiry and to file Final Report. ORDER

This petition is filed to withdraw the enquiry on the petitioner's complaint in No.G3/23455/19/1847 on the file of the first respondent and transfer the same to CBCID, Ramanathapuram to conclude the enquiry and to file Final Report.

2. When the matter was taken up for hearing on 31.08.2021, the learned Additional Public Prosecutor submitted that based upon the compliant given by the petitioner, enquiry was undertaken and during the course of enquiry, it was found that there was civil dispute and O.S.No.88 of 2004 is also pending before the District Munsif Court, Paramakudi. For the purpose of circulating the closure report, the matter was ordered to be listed today. 3.Today (05.10.2021), the closure Report was circulated to this Court. Crl.O.P.(MD)No.12487 of 2021 4.Since the compliant of the petitioner has been closed, nothing survives for further consideration or direction in this petition. The petitioner is at liberty to approach the concerned civil Court through appropriate proceedings. The petitioner can get the copy of the closure report from the office of the learned Additional Public Prosecutor.

5.With the above said liberty, this Criminal Original Petition is disposed of as infructuous.
